DELIVERY & SHIPPING OF GOODS

Digital goods are delivered immediately. Please be aware there are inherent risks associated with downloading any software and digital goods. Should you have any technical problems downloading any of our goods, please contact us so we may try to assist you.

  • All digital products are delivered free of charge as downloadable digital files to your supplied email.
  • Digital eLearning is delivered through our Thinkific member portal, you will receive an email to assign and set up your login details via your supplied email (membership to our portal is included). 
  • Online consultations are delivered via Google Meets or Zoom, they only require a free account from the users end.

Physical goods may be delivered by Australia Post and/or other reputable courier companies. Deliveries are processed promptly upon receipt of full payment. Delivery may take between 2 and 14 days, depending on the delivery option. Damaged or lost orders should be resolved with Australia Post or the courier company directly, we are not responsible for goods that are damaged in transit or not received. Replacement of damaged or lost items is made at the discretion of Marketing Your Brand.

  • ALL physical products purchased have individualised shipping prices displayed during checkout, physical shipping is varied based on order weight through Australia Post. 

RETURNS AND REFUNDS FOR PHYSICAL PRODUCT PURCHASES

Marketing Your Brand handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.

Should you wish to return your order, please notify us within 48 hours of delivery with a valid reason for return. If we are unable to resolve your complaint or further assist you, we may process a refund upon timely return of the goods purchased. All refunds are made at the discretion of Marketing Your Brand. Digital or online services, workshops, courses, eLearning, personalised or perishable goods are exempt from being refunded, please choose carefully.

VIRTUAL ONLINE CONSULTATION SERVICES

Online services provided are limited to the products and services purchased on your shop order. Should additional instructions be received by Marketing Your Brand, you will receive a further quote/invoice, as well as Terms and Conditions for such instructions. Please review them carefully.

The service you receive is limited to the specifications of the products/services provided to you on the Shop listing (specified on the associated product/service webpage) herein of the Marketing Your Brand website. Unless otherwise specified in email correspondence/writing from the Founder/Director of Marketing Your Brand. 

All original/working files remain the intellectual property of Marketing Your Brand, with a non-transferable, non-exclusive licence for use granted for the individual purchasers use only.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of our product/service, use of the product/service, or access to the product/service or any contact on the website/in-person/email through which the service is provided, without express written permission by us.

If we sign a non-disclosure agreement, we do not share outbound information with third parties without your express written permission. Please maintain your copy, as we utilise a generic NDA agreements, alterations are not made therefore we are not required to maintain copies of each signed agreement.

All research and analysis is done in accordance with the Australian Consumer and Competition Commission (ACCC), our own privacy policy, laws and regulations. 

Recorded interviews are conducted legally, and based on the state of Queensland legislation. If we are to consult your business interstate, your state legislation may not apply. Please advise us of this, so that we can make the appropriate arrangements.

Marketing Your Brand reserves the right at any time to terminate, modify or discontinue the consulting service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the service.

If false or misleading information is provided by you at any time, Marketing Your Brand reserve the right to terminate, modify or discontinue the Service (or any part or content thereof) without notice at any time.

Prior to the commencement of any consultation services from Marketing Your Brand, payments must be made and cleared, this includes clearance from finance platforms such as Humm.

Marketing Your Brand reserves the right to deny and refund either all/or part of your order/service at any time. Without notice. Please note, if your consultation services has prepurchase time, you are free to utilise those through the booking calendar. If the hours have not been expressly used by Marketing Your Brand, you may qualify for a partial refund less the client onboarding expenses and charge for our time.

ELEARNING, WORKSHOPS & COURSES

Due to the digital high-value nature of our eLearning, Workshops & Courses, we cannot offer refunds. However, if you are unsatisfied with the session you have selected, please contact us so that we may rectify the situation and assign you to an alternative workshop/course of the same value. Please note you only have 24 hours to notify us that you are unhappy with your purchase.

The ability to “learn at your own pace”, means you get lifetime access to your session once it is purchased or transferred. Our eLearning platforms may be continually updated with new resources, exercises and reading as we continue our best practice teachings. You may log into your portal at any time and learn at your own pace.

WORKSHOP CONSULTATION SERVICES 

Once workshop associated services are booked & payment has been received, you become a Temporary Client of Marketing Your Brand for the sole duration of the booking timeslot/hours. Services and advice are restricted to the timeframes of the booking time slot purchased. All due care is given to provide appropriate professional guidance and hands-on support, Marketing Your Brand Pty Ltd is reliant on the information supplied by the client in order to provide the services and cannot be held responsible for any results of our services provided based on such client information. You are liable and fully responsible for any decisions you make based on our services or recommendations and any consequences which may result.

Any and all information we provide in the consultations are for educational and informational purposes only, intended to assist you. It is not to be construed as business advice and should not substitute professional advice based on your own business or personal circumstances. Hourly consultations do not allow Marketing Your Brand to gain a clear representation of your or your business, these services should only be hired as hands-on help provided under your express verbal or written instructions.

CANCELLATIONS/RESCHEDULING OF BOOKINGS PURCHASED THROUGH THE ONLINE SHOP

We do not provide refunds or exchanges. However, in the event that you cannot make the allocated Booking Date or Time, we are happy to provide you with the opportunity to select a new scheduled date, which must be selected from the same online Calendar Booking System you.

If you are unavailable to make our scheduled booking, an email must be sent to info@marketingyourbrand.com.au making us aware of your non-attendance. Re-scheduled Bookings are subject to time slot availability. 

BRAND HEALTH CHECK, MARKETING AUDIT, WEBSITE AUDIT & LOGO DEVELOPMENT SPECIFIC TERMS & CONDITIONS

All due care is given to provide the  services within their specified timeframes (after payment clearance), however, this is an estimate. Please be mindful that delays outside of the control of Marketing Your Brand, cannot be accounted for and may delay the process accordingly. Strict adherence to Marketing Your Brand requests will further expedite the estimated timeframe.

Imagery Due to license restrictions, the images, mock-ups, text, information and content are NOT included with our digital download products.You can find the placeholder images at www.unsplash.com, a website that offers free high-quality images, or other attributed third party providers. However, you can easily drag and drop your own photos into frames on each template.

Fonts All fonts used are included in the free Canva version.

Licence Our Canva templates are © Marketing Your Brand – please do not distribute or resell these templates in whole or part. You can share the final flattened designs through your website, email list, or social media accounts but the customisable templates (even if modified) cannot be re-sold, redistributed, or claimed as your own. They are for small business use – one user only.

Refunds Due to the digital nature of this product, no refunds or returns will be accepted.

All information we receive from our customers is protected by third party secure servers for example our eCommerce platform is Shopify. Shopify’s secure server software encrypts all customer information before it is sent to us. Furthermore, all customer data collected is secured against unauthorized use or access. Credit card information is not stored by Marketing Your Brand.

Marketing Your Brand may be required, in certain circumstances, to disclose information in good faith and where Marketing Your Brand is required to do so in the following circumstances: by law or by any court; to enforce the terms of any of our customer agreements; or to protect the rights, property or safety of our customers or third parties.
